Submission Terms & Conditions
By making a submission, you agree to the following:
You represent and warrant that (a) you are the sole and exclusive creator, author and owner of the submission and all rights therein; (b) you have the full and exclusive right, power and authority to make the submission and to grant us the rights to the submission herein granted upon the terms and conditions set forth herein; (c) no part of the submission has been published; (d) no rights in the submission have been previously granted to any person, firm, corporation or other entity or otherwise exercised or exploited; (e) your submission is in keeping with our image and is not offensive, as determined by us in our sole discretion; (f) your submission does not defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or property rights or any other third party rights; and (g) all statements contained in the submission are true and accurate and based on your actual experiences and beliefs.
You grant to us and our designees a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, sub-licensable right but not the obligation to exploit the copyright, publicity, and all other rights you have in the submission, and any ancillary and subsidiary rights therein in any media now or hereafter known, without any payment or other consideration of any kind to you or other third party. We reserve all rights, including the right to edit, publish, use, adapt, exploit, modify or dispose of the submission, the concepts embodied therein or any elements thereof, proper names, likenesses, addresses and locations, online, in print, film, television, or in any other media for all lawful purposes without compensation or notification to you of any kind, except as required by law.
You agree that we and our designees have the right, but not the obligation, to use your name, voice, image and/or likeness if provided to us for advertising, publicity, promotional purposes and any other purpose we determine is appropriate in all media now or hereafter known, worldwide and, including, without limitation, in print publications and on the Internet, and in perpetuity, without compensation and without prior notice, approval or inspection.
We are not responsible for lost, damaged, misdirected, incomplete, illegible, undeliverable, destroyed or stolen submissions, or for submissions that fail to enter into the our system, or that are processed, reported, or transmitted incorrectly or are lost or misdirected for any reason including computer, telephone, paper transfer, human or other error; or for electronic, computer, or telephone malfunction or error, including inability to access any Web site associated with the program or to process any transaction thereon. You hereby release us, our affiliated corporations and our and their respective employees, licensees, agents and assigns from any liability resulting from your participating hereunder or our use of the submission. You agree to be bound by these terms and the our decisions which are final in all respects.
